California SB 199 Passes Senate

California Senate Bill 199 passed the California Senate, 22 to 8, today in Sacramento.  This bill will now move on the the California State Assembly where it will most likely first appear in the Assembly Public Safety Committee.  The strong airsoft showing in this committee for SB 798 in the Summer of 2011 made a huge impact on legislators, and it was probably partly responsible for its eventual defeat.

That committee also taught us that action taken by out-of-state airsofters did not help our cause.  We appreciate your enthusiasm, but please DO NOT contact California legislators if you are not a citizen of California.  Encourage anyone you know in California to contact THEIR legislator.  Right now the priority is for all California citizens to contact members of the California Assembly Public Safety Committee.  Use the preceding link to find contact information for the committee members.  The linked contact forms only work if you live in that particular Assemblymember’s district (Assembly Districts 15 ,17, 20, 54, 59, 67, and 75).  You can then call on the phone, write snail mail, or email something like this.

Airsoft Medicine has been working for over three years to keep airsoft fun by keeping airsoft safe.  We do not find that SB 199 will make airsoft guns safer.  The situation Senator De Leon is attempting to address with SB 199 was caused by a real gun bullet fired by a police officer as the victim was violating current law.  The passing of SB 199 would not prevent such a situation from occurring again, but it would severely effect the sport of MilSim Airsoft played every weekend by thousands of Californians on insured fields and facilities across the state.  Please also note the coloration proposed by the bill is already used in real guns as shown in this picture I took this month at the Shot Show in Las Vegas.  Senate Bill 199 will not make anyone safer.  In fact, making airsoft guns look like toys increases the risk of parents and children not taking their potential for injury seriously.

Many airsoft enthusiasts share a concern for the ready availability of replica airsoft guns to minors.  The ability to purchase these guns from “Big Box” retailers instead of dedicated specialty stores increases the number of units distributed to individuals who do not have education in the safe handling and use of these replicas.  The specialty stores are much more aware of how misuse of these products will hurt their business, and they have policies in place to educate consumers at the time of sale.  A 2013 study published in the March edition of theFrench Journal of Ophthalmology on airsoft injuries found that, “In one out of every two cases, the gun had been won at a booth in a fair or had been purchased in a big-box store.”  The conclusion of the paper proposed, “to forbid selling these guns outside of specialized stores.”

Please oppose SB 199 in its current form to protect our children, the MilSim Airsoft Sport, and the California Airsoft Industry.

    Please be respectful to your legislators in your contacts with them. Vitriol will not win the day, but sheer numbers will. If politicians are confronted with thousands of contacts in opposition, their resolve to support this bill will fade.

I am registered as Republican, however vote in the Best Interests of California and the United States, issue by issue and the individual politicians regardless of political affiliations.

    I want it clearly understood that Senator DeLeon is a Very Dangerous Man and Politician…a Demon if you wish, and he clothes himself as a “Friend to the People”, Fools Many People, but he is an “Extreme Left Winger”, just as every bit as Dangerous as the Extreme Right and Tea Party trying to kill off legislation in Congress and destroy Obama at any cost and even destroy the USA for their own gain…(see below for further information concerning Deleon). With that said, this man is an extreme Leftist (like Tea Party Nut, But On the Left Side and Not Right Side), totally Anti 1st and 2nd Amendments, Communist Acting, Socialist Acting, Leftist Bully Jack Ass, complete Anti-Gun-Air Rifle-and yes…even Airsoft Grabbing Traitor the State of California and USA. Common Sense Legislation for Fire Arms…ie. Background Checks, Waiting Periods, Fire Arm & Bullet & Ammo Licensing, Required Operation and Safety Training, etc. given the very deadly nature of these devices. However, as we all know, Airguns of all types, including Air Soft, are protected by Preempting Federal and State Law. Senator DeLeon has been attempting to chip away at these laws for years and completely take away target and small game hunting hobbies enjoyed by millions of people. Completely Coloring an Airgun or AirSoft sounds good so “police can tell the difference & not shoot kids accidentally”, is the Stupidest Legislation that this NAZI-Socialist-Communist Left Wing Nut Job (any doubts about him…look him up on his home page…this INCREDIBLE JACK ASS IS ATTEMTING TO DRIVE ENTIRE MANUFACTURING INDUSTRIES OUT OF CALIFORNIA THAT “POLLUTE” RATHER THAN WORKING WITH THEM TO IMPROVE) has ever come up with. Even Los Angeles City Council didn’t pass his SB-1315 (“Local” Airgun Coloring for Los Angeles County only) from last year after he got his Behind Kicked in the State Assembly on SB-798 (Airgun Coloring) for the State of California. Bottom line, if a Police or Deputy tell you to drop any weapon and don’t (doesn’t matter what color), you will be shot and killed as that is their training. Current Law at Federal and State Law clearly states that these weapons or “toys as DeLeon calls them” are NOT TO BE EXPOSED IN PUBLIC, IN UNAPPROVED AREAS, AND CANNOT BE OWNED OR USED BY ANYONE UNDER THE AGE OF 16.     Airguns, in and of themselves, pass muster for 2nd Ammendment Protection given that the most powerful of them (9mm, .45 Caliber, and 50 Caliber, are used for legitimate hunting, or even a choice for home protection (albeit, the airgun industry does not recommend that no airgun ever be used for such a purpose given they are afraid of additional legislation in these regards).

    SACRAMENTO – The Senate today approved the Imitation Firearms Safety Act (SB 199) by Senator Kevin de Leόn (D-Los Angeles) which requires BB, pellet and airsoft guns to be painted bright colors to help law enforcement spot them when they are confronted with youngsters playing with firearms. The vote was 22 yes – 8 noes.

    “Toy guns are deliberately made to look like real firearms which has led to fatal confusion for officers and tragic consequences for families,” said Senator De Leόn. “Painting toy guns bright colors will make them harder to mistake for real firearms.

    In 2011, Senator De Leόn authored SB 798 to require BB guns to be painted a bright color to make them more obvious to law enforcement. The measure was sponsored by Los Angeles Police Chief Charlie Beck.

    There have been several law-enforcement related shooting deaths of teenagers where toy firearms have been mistaken for real weapons. In October 2013 13-year old Andy Lopez was shot and killed while playing with a mock AK-47 which law enforcement mistook for a real weapon. The original bill was in response to an incident where another 13-year old, Rohayent Gomez, in Los Angeles was tragically shot and left a paraplegic when police mistook his replica firearm for a real weapon.

    Supporters of the bill include the City of Los Angeles, Sonoma County Sheriff’s Department, and Sonoma County District Attorney.

    The bill is joint-authored by Senators Noreen Evans (D-Santa Rosa) and Lois Wolk (D-Davis), and coauthored by Assemblymembers Wesley Chesbro (D-North Coast), Marc Levine (D-San Rafael), and Mariko Yamada (D-Davis).

      While I appreciate your zeal for common-sense approaches and protection of airsoft, I find your characterization of Senator DeLeon concerning. I hesitate to use language that strong in describing someone I still have hope to work with before this bill is done. You may be right, but I have not seen it with my own eyes yet.

      • Hi Mark,

        There really isn’t ANYTHING to worry about with my characterization of Senator DeLeon as it is all true. I’ve attempted to deal with this guy before on SB-798 and SB-1315 and he’s arrogant beyond belief!! Basically, he claims he’s right, always. Finally, on SB-798, he got soundly defeated in the assembly when I teamed up with Pyramyd Air and bombarded all of the Assembly and Senate Members with opposition letters. All I know is this, if he is so adamant about screwing around with mine or any adult over the age of 16 to own adult airguns for hunting/target shooting/plinking/or home and personal defense as non-lethal force (not everyone wants a firearm due to their deadly nature) or airsoft, he will find me just as adamant when I haul him personally into federal court and charge him civilly for 2nd amendment and Heller Violations. You see, I can make a very good case for 2nd amendment issues by looking at the power of weapons at the time when the amendment was written and was a lot more than any of today’s airguns or airsoft, yet, a lot less than today’s firearms. The 2nd Amendment states that right to bear arms shall NOT be infringed. The Supreme Court further stated in the Heller Case recently that individuals have the right to own hand guns for personal protection, however, stating that reasonable laws controlling use and availability of certain weapons are allowed (ie. you cannot own a .50 Caliber Machine Gun). There is a lot of people that chose air guns these days for a variety of reasons and uses, but are all very low power. As for home protection, some of the weapons are adequately powerful enough to stop an intruder closeup, with one distinction, the pellet or BB will not go through a wall and hit a neighbor if the intruder is missed.

        So Mark, if you have any contact with the Senator at all and you can actually talk sense to this guy (which I seriously doubt given the level of this guy’s arrogance), then present this…THE FEDERAL AND STATE LAW STATES THAT NO ONE UNDER THE AGE OF 16 MAY PURCHASE, OWN, OR USE ANY AIRGUN OR AIRSOFT WITHOUT THE STRICT SUPERVISION OF AN ADULT THAT KNOWS WHAT HE/SHE IS DOING. FURTHER, THIS IS STATED IN ALL OF THE PACKAGING, SAFETY INSTRUCTIONS, AND OWNER MANUAL OF PROPER USE ALWAYS COME WITH AIRGUNS AND AIRSOFT, AS PER FEDERAL & STATE LAW. MOST OF THE PEOPLE GETTING SHOT BY POLICE ACCIDENTALLY FOR POSSESSING A REALISTIC LOOKING AIRGUN OR AIRSOFT IS ALMOST ALWAYS UNDER THE AGE OF 16. I’M QUITE OK IF SENATOR DELEON MODIFIES HIS BILL TO MAKE A CLASS OF AIRGUNS WITH BRIGHT COLORS AND LOWER POWER (IE. LIKE A DAISY RED RYDER BB RIFLE) FOR CHILDREN UNDER THE AGE OF 16. WITH THAT SAID, IF YOU CAN GET THIS IDEA TO SENATOR DELEON AND LEAVE THE ADULT AIRGUNS (ESPECIALLY THERE ARE SOME OF US THAT ARE TRAINED MILITARILY OR OTHER WAY AND PREFER AIRGUNS FOR HOME AND SELF DEFENSE IN LIEU OF FIREARMS) AND AIRSOFT ALONE, HE WON’T FIND ANOTHER RESOUNDING DEFEAT BY MYSELF AND PYRAMYD AIR’S VAST PEOPLE BASE, INCLUDING ALL OF THE MANUFACTURERS, IN THE ASSEMBLY.         Just as a final note, I’ve read DeLeon’s other activities on his website and he seems very anti business and manufacturing. Why doesn’t he work with these people rather than trying to literally kick them all out of california? Maybe senator DeLeon is a real nice guy personally, however, I’m much more gravely concerned with the crappy legal advice he’s getting from his staff attorney’s on how to word Bills.

        Please let me know your thoughts on this blog and get this to the Senator if you know him. If he is a reasonable guy that will listen to you, my opinion of the guy will be different.

    Thanks for the Call! I’ve read your Posts and have seen some of your You Tube Posts. I have to say that I TOTALLY Agree with everything you have said and represent. Promoting Safety and Fun Purposes with AirSoft is great! However, with all that said, none of this will stop a guy like Senator DeLeon. Mark, make no mistake, this guy is dangerous and he has his own agenda.

    That why I would like to invite you and ALL of you customers, subscribers, and bloggers to join the NARA (National Air Rifle Association) to protect Airgunners, Airsoft, and Paintball. In addition, this would include Archery and High Powered Hunter sling Shots (For Target Fun and Hunting Purposes).

    Mark, please let me know if you wish to join. I’ve already solicited Pyramyd Air, as that they have a huge customer base tha defeated SB-798. I was one of the strong pushers to help defeat SB-798.
